As Partes comprometem-se a promover e a encorajar a cooperação científica e tecnológica entre a República Portuguesa e o Reino da Tailândia.
Artigo 2.º
O Governo da República Portuguesa designou o Ministério da Ciência e da Tecnologia e o Governo do Reino da Tailândia designou o Ministério da Ciência, Tecnologia e Ambiente como responsáveis pela implementação do Acordo.
Artigo 3.º
a)Formação e intercâmbio de investigadores e técnicos especialistas;
b)Conclusão de acordos de cooperação entre universidades, centros de universidades e laboratórios;
c)Estabelecimento de centros ou projectos comuns de investigação, como forma de reforçar a cooperação entre as Partes;
d)Apoio ao lançamento de iniciativas empresariais que contribuam para o desenvolvimento de projectos de investigação, em particular nas áreas da indústria, serviços e agricultura;
e)Promoção do estabelecimento de formas de cooperação que envolvam a aplicação das tecnologias de informação;
f)Aumento da cooperação no domínio da C&T, com vista a incluir outros parceiros, no âmbito da Iniciativa Eureka (nomeadamente na Iniciativa Eureka-Ásia) e nos programas específicos da União Europeia;
g)Organização de programas conjuntos de mestrado e de doutoramento.
Artigo 4.º
As actividades de cooperação desenvolvidas no âmbito deste Acordo deverão ser objecto de acordos específicos. As Partes encorajarão as autoridades competentes, em ambos os países, a propor programas ou actividades de cooperação no âmbito deste Acordo.
Artigo 5.º
As Partes deverão facilitar a implementação das actividades de cooperação pelas respectivas autoridades nos dois países.
Artigo 6.º
As actividades de cooperação empreendidas ao abrigo deste Acordo deverão ser implementadas em consonância com as leis e regulamentos aplicáveis pelas Partes.
Artigo 7.º
Os encargos decorrentes das actividades de cooperação estabelecidas no âmbito deste Acordo deverão estar conformes com as leis e regulamentos aplicáveis pelas Partes.
Artigo 8.º
Qualquer diferendo que surja entre as Partes resultante da interpretação ou aplicação deste Acordo deverá ser resolvido por consulta entre as Partes.
Artigo 9.º
1 -As Partes acordam, por este meio, em estabelecer uma comissão mista, composta por representantes designados pelas Partes, com o objectivo de coordenar, executar e avaliar o presente Acordo.
2 -A comissão mista deverá reunir pelo menos uma vez de dois em dois anos, alternadamente na República Portuguesa e no Reino da Tailândia.
Artigo 10.º
As Partes deverão partilhar, em igualdade, os benefícios das descobertas científicas e inovações tecnológicas que resultem das actividades de cooperação conduzidas no âmbito deste Acordo.
Artigo 11.º
1 -Este Acordo deverá entrar em vigor na data em que ambas as Partes notificarem a conclusão dos requisitos necessários pelos procedimentos internos para a sua entrada em vigor.
2 -Este Acordo produz efeitos por um período de três anos e manter-se-á em vigor por sucessivos períodos de três anos, salvo se uma das Partes comunicar por escrito, pelo menos com seis meses de antecedência, a sua intenção de o denunciar.
3 -Este Acordo pode terminar em qualquer momento, por iniciativa de qualquer das Partes. O término deste Acordo não deverá afectar a validade dos projectos ou actividades de cooperação implementados ao abrigo deste Acordo.
Artigo 12.º
O presente Acordo não prejudica quaisquer direitos ou obrigações que decorram de outros acordos bilaterais ou multilaterais entre qualquer das Partes e terceiros e não produzirá quaisquer efeitos sobre os direitos e obrigações das Partes derivados de acordos e ou tratados internacionais a assinar no futuro pelas Partes.
Os abaixo assinados, tendo sido devidamente autorizados pelos respectivos Governos, assinaram o presente Acordo.
Feito em Banguecoque em 22 de Agosto de 2001, em três originais, em português, tailandês e inglês, sendo os textos igualmente autênticos. No caso de divergência, o texto em inglês prevalece.

AGREEMENT ON SCIENTIFIC AND TECHNOLOGICAL COOPERATION BETWEEN THE GOVERNMENT OF THE REPUBLIC OF PORTUGAL AND THE GOVERNMENT OF THE KINGDOM OF THAILAND.
The Government of the Republic of Portugal and the Government of the Kingdom of Thailand, hereinafter referred to as the Parties:
Desiring to strengthen the historical links of friendship and cooperation between the two countries;
Referring to the Cultural Agreement between the Government of the Republic of Portugal and the Government of the Kingdom of Thailand done at Lisbon on 1 April 1985, as a suitable basis for expanding bilateral relations in the area of science and technology, in the spirit of mutual respect and reciprocity;
Being aware of the importance of scientific and technological research for the economic and social development of both countries;
Recognising that bilateral cooperation in the scientific and technological field will increase human resources potential of the Parties;
Considering that, in the world of today in which advances in knowledge and scientific innovation occur constantly, circulation and sharing of information should be encouraged and rendered systematic for easy and rapid access to all; and
Considering that such cooperation could further develop in the context of the Asia Europe Meeting process and within the framework of the European Union;
have agreed as follows:
Article 1
The Parties shall promote and encourage scientific and technological cooperation between the Republic of Portugal and the Kingdom of Thailand.
Article 2
The Government of the Republic of Portugal has designated the Ministry of Science and Technology and the Government of the Kingdom of Thailand has designated the Ministry of Science, Technology and Environment as their respective implementing agencies for the purpose of implementing this Agreement.
Article 3
Cooperation activities under this Agreement shall include:
a) Training and exchange of researchers and technical specialists;
b) Conclusion of cooperation agreements between Universities, Research Centres and Laboratories;
c) Establishing Joint Research Centres or Projects to enhance cooperation between the Parties;
d) Supporting the launch of business initiatives which contribute to and develop research projects focusing on industry services and agriculture;
e) Promoting the establishment of cooperation models involving the application of information technologies;
f) Broadening cooperation in science and technology fields in order to include other partners, under the Eureka Initiative (namely the Eureka-Asia Initiative) and in specific EU programmes;
g) Organizing joint master and doctoral programmes.
Article 4
Cooperation activities provided under this Agreement shall be subject to specific arrangements to be agreed upon. The Parties agree to encourage the authorities concerned in both countries to propose cooperation programmes or activities within the scope of this Agreement.
Article 5
The Parties shall facilitate the implementation of cooperation activities by the authorities concerned in both countries.
Article 6
Cooperation activities undertaken under this Agreement shall be implemented in accordance with the applicable laws and regulations of the Parties.
Article 7
All expenses incurred in undertaking the cooperation activities under this Agreement shall conform with applicable laws and regulations of the Parties.
Article 8
Disputes concerning the interpretation or application of this Agreement shall be settled by consultation between the Parties.
Article 9
1 - The Parties hereby agree to establish a Joint Committee which shall be composed of representatives designated by the Parties for the purpose of co-ordinating, executing and evaluating the present Agreement.
2 - The Joint Committee shall meet at least once every two years alternately in the Republic of Portugal and the Kingdom of Thailand.
Article 10
The Parties shall equally share the benefit from scientific discoveries and technological innovation resulting from the cooperation activities under this Agreement.
Article 11
1 - This Agreement shall enter into force on the date on which both Parties have notified each other that their respective internal procedures necessary for its entry into force have been completed.
2 - This Agreement shall remain in force for a period of three years and thereafter automatically extended for additional period of three years until terminated by either Contracting Party giving prior written notice, at least six months in advance to the other Contracting Party.
3 - This Agreement may be terminated at any time by either Party. The termination of this Agreement shall not affect the validity of cooperation projects or activities implemented under the terms of this Agreement.
Article 12
This Agreement is without prejudice to rights and obligations under bilateral or multilateral agreements between either the Parties with Third Parties and shall not produce any effects on the rights and obligations of the Parties, derived from future international agreements and treaties to be signed by the Parties.
In witness whereof, the undersigned, being duly authorized by their respective Governments, have signed the present Agreement.
Done at Bangkok, on the 22nd day of August 2001, in duplicate, in the Portuguese, Thai and English languages, all texts being equally authentic. In case of any divergence, the English text shall prevail.
