Artigo 1.º

As Partes facilitarão e promoverão, em conformidade com as disposições do presente Acordo, quaisquer formas de cooperação económica, científica, técnica, educacional, social e cultural que forem consideradas de benefício mútuo para as economias de ambos os países.

Artigo 2.º

A cooperação económica, científica, técnica, educacional, social e cultural entre os dois países deverá ser efectivada através de acordos separados, a concluir entre instituições ou organismos devidamente autorizados dos dois países, mediante a aprovação dos respectivos Governos e de acordo com as leis e regulamentos em vigor em cada um dos países.

Artigo 3.º

a)Cooperação na promoção da indústria, agricultura, ciência e tecnologia;

b)Cooperação nas áreas educacional, social e cultural. Cada Parte deverá estudar anualmente a possibilidade de concessão de bolsas de estudo para os nacionais da outra Parte, que lhe permita estudar ou ter formação nos centros culturais e frequentar cursos especializados em instituições de educação superior ou similares;

c)Intercâmbio de pessoal para fins de formação profissional em institutos técnicos, científicos ou outros e em fábricas ou outros centros de produção de cada país, concessão de bolsas de estudo, etc.;

d)Cooperação no domínio da investigação científica entre instituições e organismos científicos dos dois países, bem como o intercâmbio de informação e publicações de carácter científico;

e)Cooperação em projectos de interesse comum, incluindo a aquisição de licenças e o intercâmbio de conhecimentos científicos e tecnológicos;

f)Fornecimento de serviços de peritos;

g)Intercâmbio e cedência de documentação técnica e, nos casos em que tal for aplicável, do necessário equipamento, incluindo a troca de informações;

h)Cooperação com vista a garantir o melhor aproveitamento das suas potencialidades turísticas e o intercâmbio de turistas entre os dois países.

Artigo 4.º

A fim de determinar periodicamente o volume e as condições da cooperação e verificar os progressos assim realizados, os representantes das Partes reunir-se-ão alternadamente em cada um dos países, como e quando necessário. As decisões destes encontros ficarão sujeitas a aprovação das competentes autoridades de ambos os países.

Artigo 5.º

As Partes designam os respectivos Ministros dos Negócios Estrangeiros como órgãos competentes para a efectivação do presente Acordo e dos assuntos com ele relacionados. As Partes terão a faculdade de designar por escrito, a todo o momento, qualquer outra entidade, organismo ou ministério para a execução efectiva de qualquer aspecto de cooperação previsto no presente Acordo.

Artigo 6.º

Os termos e as condições de serviço de peritos e dos que frequentarem cursos de formação profissional, bem como de quaisquer outras modalidades de cooperação mencionadas no artigo 3.º, serão ajustados em cada caso entre os respectivos representantes, por meio de contratos individuais ou dos protocolos contemplados no artigo 2.º do presente Acordo.

Nos casos em que tal se mostre necessário ou desejável, estes termos e condições deverão também prover no sentido de não serem divulgados os documentos, dados ou informações que possam ser obtidos pela Parte receptora. As Partes não cederão, nem por qualquer outro modo revelarão, tais documentos, dados ou informações a uma terceira Parte sem o consentimento escrito da outra.

Artigo 7.º

As pessoas envolvidas no exercício de quaisquer funções ao abrigo do presente Acordo deverão observar as leis e regulamentos vigentes em cada um dos dois países.

Artigo 8.º

O presente Acordo não prejudicará a validade nem as obrigações decorrentes de qualquer convenção internacional, tratado ou protocolo assinado por cada Parte.

Artigo 9.º

As Partes acordam em solucionar quaisquer litígios emergentes deste Acordo por meio de negociação mútua.

Artigo 10.º

Qualquer alteração ao presente Acordo deverá ser feita mediante o consentimento escrito das Partes.

Artigo 11.º

1 -O presente Acordo entrará em vigor na data da sua assinatura e manter-se-á válido por um período de três anos.

2 -A validade do presente Acordo será automaticamente prorrogada por subsequentes períodos de três anos, salvo se qualquer das Partes o denunciar por escrito com a antecedência de três meses.

3 -As disposições do presente Acordo, bem como as de quaisquer protocolos, acordos ou contratos separados concluídos no seu âmbito, manter-se-ão aplicáveis, após o termo da sua validade, a todas as obrigações ou projectos pendentes e não expirados que tenham já sido assumidos ou cuja execução tenha já sido iniciada na vigência do mesmo Acordo. AGREEMENT BETWEEN THE REPUBLIC OF PORTUGAL AND THE KINGDOM OF SWAZILAND ON ECONOMIC, SCIENTIFIC, TECHNICAL, EDUCATIONAL, SOCIAL AND CULTURAL CO-OPERATION The Government of the Republic of Portugal and the Kingdom of Swaziland (hereinafter called the Parties): Desirous of strengthening their ties of friendship and of promoting economic, scientific, technical, educational, social and cultural co-operation between two countries; and Aware of the advantages which can arise from such co-operation for both countries, have agreed as follows: Article 1 The Parties shall facilitate and promote, in conformity with the provisions of this Agreement, any form of economic, scientific, technical, educational, social and cultural co-operation that they may deem mutually useful to the economies of their coutries. Article 2 The economic, scientific, technical, educational, social and cultural co-operation between the two countries shall be effected through separate agreements to be concluded between duly authorized institutions or bodies of the two countries subject to the approval of the two Governments and in accordance with the laws and regulations for the time being in force in each country. Article 3 The economic, scientific, technical, educational, social and cultural co-operation shall include, among other things, the following activities, having always in view their possible extension to such forms as may be mutually useful:

a)Co-operation in the promotion of industry, agriculture, science and technology;

b)Co-operation in educational, social and cultural fields. Each Party shall study the possibility of granting scholarships annually to the nationals of the other Party, which may enable them to study or have training in cultural centres and to attend specialised courses in higher educational or similar institutions;

c)Exchange of personnel for training purposes in technical schools, scientific, and other institutions, factories and other prodution centres in each country, grant of scholarschips, etc.;

d)Co-operation in scientific research between scientific institutions and bodies of the two countries, and exchange of information and scientific publications;

e)Co-operation in projects of common interest, including acquisition of licences and exchanges of scientific and technical expertise;

f)Provision of the service of experts;

g)Exchange and giving of technical documentation and, where applicable, necessary equipment, including the exchange of information;

h)Co-operation in ensuring the optimal harnessing of their tourist potential and instituting exchange of tourists between their two countries. Article 4 In order to establish periodically the volume and conditions of the co-operation and the review the progress thus made, the representatives of the Parties shall meet alternately in each country as and when necessary. The decisions of these meetings shall be subject to the approval of the competent authorities of both countries. Article 5 The Parties hereby designate their respective Ministries of Foreign Affairs as the appropriate organs of the purpose of implementing this Agreement and matters related there to. The Parties shall have the right to designate in writing at any time any appropriate body, organization or ministry for the effective execution of any aspect of co-operation under this Agreement. Article 6 The terms and conditions of service of the experts and trainees and of all other forms of co-operation mentioned in article 3 above shall be agreed upon in each case between their respective representatives in individual agreements or protocols contempleted in article 2 of this Agreement. Where necessary or desirable, these terms and conditions shall also provide against the disclosure of such documents, data or information as may be acquire by the recipient Party. The Parties shall not cede or otherwise disclose any such documents, data or informations to any third Party without the written consent of the other. Article 7 The personnel involved in any assignment under this Agreement shall comply with the laws and regulations for the time being in force in either country. Article 8 This Agreement shall not prejudice the validity of, or obligations arising from, any international convention, treaty or protocol signed by either Party. Article 9 The Parties agree to resolve any disputes arising from this Agreement by mutual negotiation. Article 10 Any amendment to this Agreement shall be made by written consent of the Parties.
