Resolução da Assembleia da República n.º 139/2019

Artigo 1.º

Objeto

O presente Acordo tem por objeto estabelecer o enquadramento formal para a cooperação entre as Partes no domínio da defesa dentro dos limites das suas competências nacionais.

Artigo 2.º

Áreas de cooperação

1 -A cooperação entre as Partes realiza-se nas seguintes áreas:

a)Política de defesa e segurança;

b)Legislação de defesa e militar;

c)Desarmamento e controlo de armamento;

d)Planeamento e orçamento;

e)Logística e aquisições;

f)Cooperação civil-militar;

g)Indústrias de defesa e equipamento militar;

h)Formação, treino e exercícios;

j)Operações de apoio à paz e operações de manutenção de paz;

k)Gestão de crises;

l)Questões ambientais em instalações militares;

m)História militar, publicações e museus;

n)Atividades sociais, desportivas e culturais;

o)Outras áreas de interesse mútuo acordadas por escrito entre as Partes.

2 -Com vista ao cumprimento das disposições do presente Acordo e à implementação da cooperação nas áreas acima mencionadas, as Partes podem concluir protocolos e acordos específicos.

Artigo 3.º

Formas de cooperação

a)Intercâmbio de conferencistas e frequência de cursos, seminários e simpósios organizados pelas Partes;

b)Participação conjunta em iniciativas multilaterais no âmbito da Organização do Tratado do Atlântico Norte (OTAN), da União Europeia (UE) e com países terceiros ou outras organizações internacionais;

c)Visitas oficiais e de trabalho de delegações chefiadas por representantes das Partes;

d)Troca de experiências entre peritos das Partes em assuntos de defesa;

e)Intercâmbio de observadores em exercícios militares;

f)Troca de informação técnica, tecnológica e industrial e utilização das suas capacidades em áreas de interesse mútuo, de acordo com os regulamentos internos das Partes;

g)Reuniões de representantes das instituições militares;

h)Intercâmbio de palestrantes e participação em cursos, seminários e simpósios organizados pelas Partes;

i)Participação conjunta em iniciativas multilaterais no âmbito da Organização do Tratado do Atlântico Norte (NATO), no âmbito da União Europeia e com países terceiros ou outras organizações internacionais.

Artigo 4.º

Autoridades competentes

Para a coordenação e implementação do presente Acordo, as Partes designam, como autoridades competentes, as respetivas organizações de política de defesa, dos Ministérios da Defesa.

Artigo 5.º

Aspetos financeiros

Cada Parte cobrirá as suas próprias despesas decorrentes das atividades de cooperação bilateral executadas sob o presente Acordo, exceto se acordado de outra forma, por escrito, entre as Partes.

Artigo 6.º

Proteção da informação classificada

A proteção da informação classificada a ser trocada entre as Partes deverá respeitar os termos do Acordo de Proteção de Informação Classificada entre a República Portuguesa e a República da Estónia, assinado em 29 de novembro de 2005.

Artigo 7.º

Relação com outras convenções internacionais

As disposições do presente Acordo não prejudicam os direitos e obrigações decorrentes de convenções internacionais de que ambas as Partes sejam parte e não serão utilizadas contra Estados terceiros.

Artigo 8.º

Solução de controvérsias

Qualquer controvérsia relativa à interpretação ou à aplicação do presente Acordo será solucionada através de negociação entre as Partes, por via diplomática.

Artigo 9.º

Revisão

1 -O presente Acordo pode ser objeto de revisão a pedido de qualquer das Partes.

2 -As emendas entram em vigor nos termos previstos no artigo 11.º do presente Acordo.

Artigo 10.º

Vigência e denúncia

1 -O presente Acordo permanece em vigor por um período de tempo ilimitado.

2 -Qualquer das Partes poderá, a qualquer momento, denunciar o presente Acordo mediante notificação prévia, por escrito e por via diplomática.

3 -O presente Acordo cessa a sua vigência seis meses após a data da receção da respetiva notificação.

Artigo 11.º

Entrada em vigor

O presente Acordo entra em vigor 30 dias após a data da receção da última notificação, por escrito e por via diplomática, pela qual as Partes informam mutuamente de que foram cumpridos os requisitos de direito interno necessários para a sua entrada em vigor.

Artigo 12.º

Registo

1 -The co-operation between the Parties shall be developed in the following areas:

a)Defence and security policy;

b)Defence and military legislation;

c)Arms control and disarmament;

d)Planning and budgeting;

e)Logistics and procurement;

f)Civil-military cooperation;

g)Defence industries and military equipment;

h)Education, training and exercises;

j)Peacekeeping and peace enforcement;

k)Crises management;

l)Environmental issues within military facilities;

m)Military history, publications and museums;

n)Social, sports and cultural activities;

o)Other mutual interest areas that will be agreed by written consent of the Parties.

2 -In order to fulfil the provisions of the present Agreement and to implement the co-operation in the areas mentioned above, the Parties may conclude specific instruments. Article 3 Forms of co-operation The co-operation between the Parties shall be implemented in the following forms:

a)Official and working visits of delegations headed by representatives of the Parties;

b)Exchange of experience between experts of the Parties in defence areas;

c)Exchange of observers to military exercises;

d)Exchange of technical, technological and industrial information and use of their capacities in areas of mutual interest, according to the national regulations of the Parties;

e)Meetings of representatives of military institutions;

f)Exchange of lecturers and attendance to courses, seminars and symposia organized by the Parties;

g)Joint participation in multilateral initiatives under the North Atlantic Treaty Organization (NATO), within the European Union (EU) and with third countries or other international organizations. Article 4 Competent authorities For coordination of the implementation of the present Agreement the Parties designate, as competent authorities, their respective Defence Policy organisations within the Ministries of Defence. Article 5 Financial aspects Each Party will cover its own costs deriving from the bilateral co-operation activities executed under the present Agreement unless otherwise agreed by the Parties in written form. Article 6 Security of classified information The protection of Classified Information to be exchanged between the Parties shall be in compliance with the terms of the Agreement on the Protection of Classified Information between the Republic of Estonia and the Portuguese Republic, signed on November 29, 2005. Article 7 Relations with other international conventions The present Agreement shall not affect the rights and obligations of the Parties arising from international conventions to which they are Parties and shall not be used against Third States. Article 8 Settlement of disputes Any dispute concerning the interpretation or application of the present Agreement shall be settled through negotiation, through the diplomatic channels. Article 9 Amendment

3 -The present Agreement shall terminate six months after the receipt of such notification. Article 11 Entry into force The present Agreement shall enter into force thirty days after the date of receipt of the later of the notifications, in writing through diplomatic channels, conveying the completion of the internal procedures of each Party required for that purpose. Article 12 Registration Upon the entry into force of the present Agreement, the Party in whose territory it is signed shall transmit it to the Secretariat of the United Nations for registration, in accordance with article 102 of the Charter of the United Nations, and shall notify the other Party of the completion of this procedure as well as of its registration number. Done in Tallin on the 1st of June of 2018, in two originals, in the portuguese, estonian, and english languages, all texts being equally authentic.
