Resolução da Assembleia da República n.º 56/97

Artigo 1.º

As Partes manterão e desenvolverão a cooperação bilateral no domínio militar em áreas de mútuo interesse e promoverão contactos militares entre as Forças Armadas da República Portuguesa e da República da Polónia.

Artigo 2.º

1 -As áreas e forma da cooperação militar serão acordadas conjuntamente pelos representantes das Partes na Comissão Mista mencionada no artigo 4.º deste Acordo e serão incluídas em programas de cooperação bilateral.

2 -De forma a implementar a cooperação nas áreas acordadas, podem ser celebrados acordos específicos ou protocolos adicionais contendo os pormenores respeitantes a essas matérias.

Artigo 3.º

1 -O pessoal envolvido nas acções de cooperação obedecerá aos regulamentos de cada uma das Partes respeitantes à protecção de informação classificada fornecida pela outra Parte durante a cooperação.

2 -Toda a informação militar classificada directamente trocada entre as Partes e a informação de interesse comum obtida de outras formas por cada uma das Partes será protegida de acordo com os seguintes princípios: - A Parte destinatária não difundirá a informação a países terceiros sem a prévia aprovação da Parte remetente; - A Parte destinatária procederá à classificação de igual grau ao atribuído pela Parte remetente e consequentemente tomará as necessárias medidas de protecção; - A informação será usada apenas para a finalidade para que foi fornecida ou obtida.

3 -Os direitos sobre patentes, royalties e segredo comercial, no domínio militar, das indústrias de defesa, ou outras, serão rigorosamente observados.

4 -A informação será canalizada pelas vias oficiais e somente o pessoal autorizado terá acesso àquela, apenas a podendo utilizar para as finalidades da cooperação entre as Partes.

5 -A reprodução temporária ou definitiva, a transferência ou cedência a terceiras Partes de informação, documentos, equipamento e tecnologia produzidos em cooperação requerirá o consentimento, por escrito, da outra Parte.

Artigo 4.º

1 -Será criada entre as Partes uma Comissão Mista no âmbito da cooperação bilateral militar com o objectivo de implementar as disposições deste Acordo, e que será adiante chamada Comissão.

2 -A Comissão reunir-se-á por regra uma vez por ano, alternadamente em Portugal e na Polónia, e será presidida pelos chefes de ambas as delegações.

3 -A agenda das reuniões da Comissão será definida por comum acordo e com a necessária antecedência, pelo menos um mês antes da reunião.

4 -No respeitante às disposições do presente Acordo, as Partes assumem o compromisso de elaborar um programa anual de cooperação, nos termos a ser estabelecidos pela Comissão, tal como referido no artigo 4.º, n.º 1, deste Acordo.

Artigo 5.º

a)O país hospedeiro suportará as despesas com alojamento, alimentação e transporte dentro do seu território, assim como os serviços médicos em caso de emergência;

b)O país visitante suportará as despesas com o transporte internacional e quaisquer outras despesas para além das acima mencionadas.

Artigo 6.º

As disposições do presente Acordo serão executadas entre as Partes segundo a legislação nacional de ambos os países e no cumprimento das normas do direito internacional.

Artigo 7.º

Qualquer divergência acerca da interpretação das cláusulas deste Acordo será resolvida pelas Partes com a maior brevidade possível através de consultas no seio da Comissão.

Artigo 8.º

O presente Acordo não prejudica os compromissos assumidos pelas Partes noutros acordos internacionais em que sejam, igualmente, Partes, nem pretende atentar contra a integridade territorial ou a segurança de Estados terceiros.

Artigo 9.º

Quando uma das Partes não puder cumprir as disposições do presente Acordo ou quiser propor aditamentos ou alterações, as Partes iniciarão consultas no seio da Comissão com vista a resolver o problema.

Artigo 10.º

1 -O presente Acordo terá uma duração ilimitada.

2 -Este Acordo poderá ser denunciado por qualquer das Partes; nessa eventualidade, deixará de ser válido seis meses após a recepção, por uma das Partes, de uma comunicação escrita pela outra Parte.

a)The recipient Party will not disclose the information to third Parties without the previous approval of the sending Party;

b)The recipient Party will provide the same classification as given by the sending Party and consequently will take the necessary protection measures;

c)The information will be used only for the purpose for which it was provided.

3 -O presente Acordo entrará em vigor após a notificação das Partes do cumprimento das formalidades exigidas para o efeito pela Constituição de cada uma das Partes. Feito em Varsóvia, em 12 de Julho de 1995, em duas cópias em língua portuguesa, polaca e inglesa, todas fazendo igualmente fé. (ver documento original) AGREEMENT BETWEEN THE MINISTRY OF NATIONAL DEFENCE OF THE PORTUGUESE REPUBLIC AND THE MINISTRY OF NATIONAL DEFENCE OF THE REPUBLIC OF POLAND ON THE BILATERAL MILITARY CO-OPERATION. The Ministry of National Defence of the Portuguese Republic and the Ministry of National Defence of the Republic of Poland, hereinafter referred to as «Parties»: Guided by the provisions of the Final Act of the Conference on Security and Co-operation in Europe, the Paris Charter of a New Europe, and the Vienna Document 1994, the Treaty of Conventional Armed Forces in Europe as well as other international agreements in the field of security, and confidence building measures; Wishing to develop and strengthen the bilateral co-operation in the field of defence, including military contacts between the Armed Forces of the Portuguese Republic and the Armed Forces of the Republic of Poland; Convinced that the bilateral co-operation and military contacts between the Parties contribute to strengthening of mutual trust and to consolidating of security in Europe and in the world; have decided as follows: Article 1 The Parties will maintain and develop bilateral military co-operation in areas of mutual interest, and will promote military contacts between the Armed Forces of the Portuguese Republic and the Armed Forces of the Republic of Poland. Article 2

4 -The information will be conveyed through official channels and only authorised personnel will have access to it, taking into account that it only can be used for the purpose of the co-operation of the Parties.

a)The receiving Party will bear the expenses for accommodation and food, transportation on its own territory, catering at the place of activity, as well as basic medical services in emergency cases;

b)The sending Party will bear the expenses for international transportation and any other expenses, except the above mentioned. Article 6 The provisions of this Agreement will be executed between the Parties, according to legislation of the country and in observation of the rules of international law. Article 7 Any divergence about the interpretation of the clauses of this Agreement will be solved by the Parties as soon as possible, through consultations within the Commission. Article 8 This Agreement will not affect the commitments resulting for each Party from other international agreements in which they are Parties too, and is not directed against the security and the territorial integrity of other states. Article 9 Whenever one of the Parties is unable to comply with the provisions of this Agrement or wants to propose amendments or changes, the Parties will begin consultations within the Commission, in order to solve the problem. Article 10

5 -Temporary or definitive reproduction, transfer or cession to third Parties of information, documents, equipment and technology produced in co-operation will require the written consent of the other Party. Article 4
