Definições

Para os fins do presente Acordo, a expressão:

a)«Parte da condenação» significa a Parte na qual foi condenada a pessoa que pode ser ou já foi transferida;
b)«Parte da execução» significa a Parte para a qual a pessoa condenada pode ser ou já foi transferida;
c)«Pessoa condenada» significa uma pessoa que deverá ser detida num estabelecimento prisional, hospital ou qualquer outra instituição na jurisdição da Parte da condenação a fim de cumprir uma pena;
d)«Condenação» significa qualquer pena ou medida privativa da liberdade, por um período determinado ou indeterminado, proferida por um tribunal, no exercício da sua jurisdição penal.

Princípios gerais

Uma pessoa condenada pode, em conformidade com as disposições do presente Acordo, ser transferida do território da Parte da condenação para o território da Parte da execução para aí cumprir a pena que lhe foi imposta.

Artigo 3.º

Autoridades centrais

1 -As autoridades centrais das Partes darão, de acordo com as disposições do presente Acordo, seguimento aos pedidos de transferência.
2 -A autoridade central da República Portuguesa será a Procuradoria-Geral da República. A autoridade central da Região Administrativa Especial de Hong Kong será o Ministro da Justiça (Secretary of Justice) ou um funcionário por ele designado. No caso de uma das Partes designar outra autoridade central deverá notificar a outra Parte.
3 -Para os fins do presente Acordo, as autoridades centrais comunicarão directamente entre si.

Artigo 4.º

Condições da transferência

A transferência de uma pessoa condenada apenas pode ter lugar nas seguintes condições:

a)Se a conduta que originou a aplicação da pena constitui uma infracção penal face à lei da Parte da execução se tivesse sido praticada dentro da jurisdição dos seus tribunais;
b)Quando a Região Administrativa Especial de Hong Kong for a Parte da execução e a pessoa condenada for um residente permanente da Região Administrativa Especial de Hong Kong ou tiver ligações estreitas com a Região Administrativa Especial de Hong Kong;
c)Quando a República Portuguesa for a Parte da execução e a pessoa condenada for um seu nacional ou tiver um estatuto de residente permanente na República Portuguesa ou tiver com ela ligações estreitas;
d)Se a pena imposta à pessoa condenada implicar pena de prisão, internamento em estabelecimento prisional ou qualquer outra forma de privação de liberdade em qualquer instituição, sendo a condenação:
1. i)Uma pena de prisão perpétua;
2. ii)Por um período indeterminado devido a uma anomalia psíquica; ou
3. iii)Por um período determinado em que reste ainda por cumprir, à data da recepção do pedido de transferência, pelo menos, um ano;
e)Se a sentença tiver transitado e não houver, relativamente a essa infracção ou a qualquer outra, mais processos pendentes na Parte da condenação;
f)Se ambas as Partes e a pessoa condenada derem o seu consentimento. Se, em virtude da idade e estado físico e mental da pessoa, uma das Partes o considerar necessário, o consentimento da pessoa condenada pode ser dado por um seu representante.

Artigo 5.º

Processo de transferência

1 -As Partes deverão diligenciar no sentido de informar as pessoas condenadas do seu direito à transferência ao abrigo do presente Acordo.
2 -O pedido de transferência pode ser formulado pelas Partes reciprocamente. Se a pessoa condenada desejar ser transferida, pode expressar tal desejo à Parte da condenação ou à Parte da execução que, antes de tomarem uma decisão relativa ao pedido de transferência, irão tomar em consideração o desejo expresso face ao critério especificado no artigo 4.º
3 -Sempre que um pedido de transferência for formulado, a Parte da condenação deverá fornecer à Parte da execução as seguintes informações:
1. a)Uma exposição dos factos que serviram de fundamento à declaração de culpabilidade e à condenação e o texto das disposições legais aplicáveis à infracção;
2. b)A data do termo da pena, se aplicável, e o tempo da pena efectivamente cumprido pela pessoa condenada e quaisquer reduções do tempo da pena a cumprir aos quais essa pessoa tem direito em virtude do trabalho realizado, bom comportamento, prisão preventiva ou outras razões;
3. c)Uma cópia da certidão da declaração de culpabilidade e da condenação.
4 -Qualquer das Partes deverá, tanto quanto possível, fornecer à outra Parte, caso esta o solicite, quaisquer informações relevantes, documentos ou declarações antes de formular um pedido de transferência ou de decidir se concorda ou não com a transferência.
5 -A Parte da condenação deverá facultar à Parte da execução a possibilidade de, caso esta assim o desejar, verificar por intermédio de um funcionário designado pela Parte da execução, numa fase anterior à transferência, se o consentimento da pessoa condenada em relação à transferência, em conformidade com o artigo 4.º, alínea f), do presente Acordo, foi dado voluntariamente e com plena consciência das consequências daí decorrentes.
6 -A entrega da pessoa condenada pelas autoridades da Parte da condenação às autoridades da Parte da execução deverá ter lugar dentro do território da Parte da condenação em data e local a acordar por ambas as Partes.

Artigo 6.º

Execução de uma condenação

1 -A Parte da condenação considerar-se-á competente para rever as declarações de culpabilidade e as condenações impostas pelos seus tribunais.
2 -Nos termos do n.º 5, a Parte da execução deverá fazer executar a condenação como se tivesse sido imposta na Parte da execução e como se tivesse a mesma duração ou a mesma data para o termo da pena indicada pela Parte da condenação.
3 -A continuação da execução da condenação, após a transferência, reger-se-á segundo as leis e procedimentos da Parte da execução, incluindo as condições que regulam o cumprimento da pena de prisão, o internamento em estabelecimento prisional ou outra privação da liberdade, e as condições que permitem a redução da pena de prisão, do internamento em estabelecimento prisional ou outra privação da liberdade, pela aplicação do regime de prova, liberdade condicional, perdão ou quaisquer outras.
4 -Se a natureza ou a duração da condenação forem incompatíveis com a legislação da Parte da execução, esta pode adaptá-la à condenação prevista na sua própria lei para infracções da mesma natureza. A condenação adaptada não pode ser mais grave, pela sua natureza ou duração, do que a imposta pela Parte da condenação.
5 -A Parte da execução alterará ou porá fim à execução da condenação logo que seja informada pela Parte da condenação de qualquer decisão tomada por esta última, em conformidade com o n.º 1, com vista a conceder o perdão à pessoa condenada ou de qualquer outra decisão ou medida tomada pela Parte da condenação e que tenha como efeito retirar à condenação o seu carácter executório ou reduzi-lo.
6 -A Parte da execução pode, se a pessoa condenada for, de acordo com a sua lei, um jovem adulto, tratar a pessoa condenada como tal, independentemente do estatuto que este possuir à luz da lei da Parte da condenação.
7 -A Parte da execução deverá informar a Parte da condenação:
1. a)Quando a pessoa condenada for libertada;
2. b)Se a pessoa condenada for libertada condicionalmente; ou
3. c)Se a pessoa condenada se evadir antes de terminada a execução da condenação.
8 -A Parte da execução deverá, caso a Parte da condenação o solicite, fornecer quaisquer informações solicitadas relativamente à execução da condenação.

Artigo 7.º

Trânsito de pessoas condenadas

Se uma das Partes transferir uma pessoa condenada para ou a partir de outro território, a outra Parte poderá cooperar no sentido de facilitar o trânsito do condenado pelo do seu território. A Parte que pretende proceder ao trânsito deverá avisar previamente a outra Parte.

Artigo 8.º

Língua

Todos os pedidos de transferência apresentados por uma das Partes deverão ser redigidos ou traduzidos numa língua oficial da outra Parte. Todos os documentos remetidos por uma das Partes para apoio a um pedido de transferência deverão ser acompanhados, se tal for solicitado pela outra Parte, por uma tradução numa língua oficial dessa outra Parte.

Artigo 9.º

Despesas

As despesas decorrentes da transferência de pessoas condenadas ou da continuação da execução da condenação após a transferência serão suportadas pela Parte da execução. Esta pode, no entanto, tentar reaver junto da pessoa condenada, no todo ou em parte, as despesas decorrentes da transferência.

Artigo 10.º

Resolução de diferendos

Quaisquer diferendos relacionados com a interpretação, aplicação ou implementação do presente Acordo serão resolvidos através das vias diplomáticas caso as autoridades centrais não consigam, elas próprias, chegar a um acordo.

Artigo 11.º

Disposições finais

1 -O presente Acordo entrará em vigor 30 dias após a data em que as Partes tenham procedido à notificação recíproca por escrito de que se encontram preenchidos os respectivos requisitos para a sua entrada em vigor.
2 -Qualquer das Partes pode, a todo o momento, denunciar o presente Acordo mediante aviso por escrito. Nesse caso, o Acordo deixará de vigorar três meses após a data da recepção do referido aviso.
Em fé do que os signatários, devidamente autorizados pelos seus respectivos Governos, assinaram o presente Acordo.

AGREEMENT BETWEEN THE GOVERNMENT OF THE PORTUGUESE REPUBLIC AND THE GOVERNMENT OF THE HONG KONG SPECIAL ADMINISTRATIVE REGION OF THE PEOPLE'S REPUBLIC OF CHINA CONCERNING TRANSFER OF SENTENCED PERSONS.
The Government of the Portuguese Republic and the Government of the Hong Kong Special Administrative Region of the People's Republic of China (Hong Kong Special Administrative Region), having been duly authorised to conclude this Agreement by the Central People's Government of the People's Republic of China, desiring to co-operate in the transfer of sentenced persons to facilitate their reintegration into society, have agreed as follows:
Article 1
Definitions
For the purposes of this Agreement:
1. a)«Transferring Party» means the Party from whose jurisdiction the sentenced person may be, or has been, transferred;
2. b)«Receiving Party» means the Party to whose jurisdiction the sentenced person may be, or has been, transferred;
3. c)«Sentenced person» means a person who is required to be detained in a prison, a hospital or any other institution in the jurisdiction of the transferring Party to serve a sentence;
4. d)«Sentence» means any punishment or measure involving deprivation of liberty ordered by a court for a limited or unlimited period of time in the course of the exercise of its criminal jurisdiction.
  Article 2
  General principles
  A sentenced person may be transferred from the jurisdiction of the transferring Party to the jurisdiction of the receiving Party in accordance with the provisions of this Agreement in order to serve the sentence imposed on him.
  Article 3
  Central Authorities
1 -The Central Authorities of the Parties shall process requests for transfer in accordance with the provisions of this Agreement.
2 -The Central Authority for the Portuguese Republic is the Procuradoria-Geral da República. The Central Authority for the Hong Kong Special Administrative Region is the Secretary for Justice or an officer authorized by the Secretary for Justice. Either Party may change its Central Authority in which case it shall notify the other of the change.
3 -The Central Authorities may communicate directly with each other for the purposes of this Agreement.
Article 4
Conditions for transfer
A sentenced person may be transferred only on the following conditions:
1. a)The conduct on account of which the sentence has been imposed would constitute a criminal offence according to the law of the receiving Party if it had been committed within the jurisdiction of its courts;
2. b)Where the Hong Kong Special Administrative Region is the receiving Party the sentenced person is a permanent resident of the Hong Kong Special Administrative Region or has close ties with the Hong Kong Special Administrative Region;
3. c)Where the Portuguese Republic is the receiving Party the sentenced person is a Portuguese citizen or has permanent resident status in the Portuguese Republic or has close ties with the Portuguese Republic;
4. d)The sentence imposed on the sentenced person is one of imprisonment, confinement or any other form of deprivation of liberty in any institution:
  1. i)For life;
  2. ii)For an indeterminate period on account of mental incapacity; or
  3. iii)For a fixed period of which at least one year remains to be served at the time of the request for transfer;
5. e)The judgement is final and no further proceedings relating to the offence or any other offence are pending in the transferring Party;
6. f)The transferring and receiving Parties and the sentenced person all agree to the transfer, provided that, where in view of age or physical or mental condition either Party considers it necessary, the sentenced person's consent may be given by a person entitled to act on his behalf.
  Article 5
  Procedure for transfer
1 -The Parties shall endeavour to inform sentenced persons of their right to transfer under this Agreement.
2 -A request for transfer may be made by the transferring Party or the receiving Party to the other Party. If the sentenced person wishes to be transferred, he may express such a wish to the transferring Party or the receiving Party, which shall consider such an expressed wish against the criteria set out in article 4 before deciding whether to request a transfer.
3 -Where a request for transfer has been made the transferring Party shall provide the receiving Party with the following information:
1. a)A statement of the facts upon which the conviction and sentence were based and the text of the legal provisions creating the offence;
2. b)The termination date of the sentence, if applicable, and the length of time already served by the sentenced person and any remissions to which he is entitled on account of work done, good behaviour, pre-trial confinement or other reasons;
3. c)A copy of the certificate of conviction and sentence.
4 -Either Party shall, as far as possible, provide the other Party, if it so requests, with any relevant information, documents or statements before making a request for transfer or taking a decision on whether or not to agree to the transfer.
5 -The transferring Party shall afford an opportunity to the receiving Party, if the receiving Party so desires, to verify through an official designated by the receiving Party, prior to the transfer, that the sentenced person's consent to the transfer in accordance with article 4, f), of this Agreement is given voluntarily and with full knowledge of the consequences thereof.
6 -Delivery of the sentenced person by the authorities of the transferring Party to those of the receiving Party shall occur on a date and at a place within the jurisdiction of the transferring Party agreed upon by both Parties.
Article 6
Enforcement of sentence
1 -The transferring Party shall retain jurisdiction for the review of convictions and sentences imposed by its courts.
2 -Subject to paragraph 5, the receiving Party shall enforce the sentence as if the sentence had the same duration or termination date as advised by the transferring Party and had been imposed in the receiving Party.
3 -The continued enforcement of the sentence after transfer shall be governed by the laws and procedures of the receiving Party, including those governing conditions for service of imprisonment, confinement or other deprivation of liberty, and those providing for the reduction of the term of imprisonment, confinement or other deprivation of liberty by parole, conditional release, remission or otherwise.
4 -If the sentence is by its nature or duration incompatible with the law of the receiving Party that Party may adapt the sentence in accordance with the sentence prescribed by its own law for a similar offence. The adapted sentence shall be no severer than that imposed by the transferring Party in terms of nature or duration.
5 -The receiving Party shall modify or terminate enforcement of the sentence as soon as it is informed of any decision by the transferring Party in accordance with paragraph 1 to pardon the sentenced person, or of any other decision or measure of the transferring Party that results in cancellation or reduction of the sentence.
6 -The receiving Party may, if a sentenced person would be a juvenile according to its law, treat the sentenced person as a juvenile regardless of his or her status under the law of the transferring Party.
7 -The receiving Party shall inform the transferring Party:
1. a)When the sentenced person is discharged;
2. b)If the sentenced person is granted conditional release; or
3. c)If the sentenced person has escaped from custody before enforcement of the sentence has been completed.
8 -The receiving Party shall, if the transferring Party so requests, provide any information requested in relation to the enforcement of the sentence.
Article 7
Transit of sentenced person
If either Party transfers a sentenced person to or from another jurisdiction, the other Party may co-operate in facilitating the transit through its territory of such a sentenced person. The Party intending to make such a transfer shall give advance notice to the other Party of such transit.
Article 8
Language of documentation
All requests for transfer submitted by one Party shall be in, or translated into, an official language of the other Party. All documents submitted by a Party in support of a request for transfer shall be accompanied, if so required by the other Party, by a translation into an official language of that other Party.
Article 9
Expenses
The expenses incurred in the transfer of the sentenced person or in the continued enforcement of the sentence after transfer shall be borne by the receiving Party. The receiving Party may, however, seek to recover all or part of the cost of transfer from the sentenced person.
Article 10
Settlement of disputes
Any dispute arising out of the interpretation, application or implementation of this Agreement shall be resolved through diplomatic channels if the Central Authorities are themselves unable to reach agreement.
Article 11
Final provisions
1 -This Agreement shall enter into force thirty days after the date on which the Parties have notified each other in writing that their respective requirements for the entry into force of this Agreement have been completed with.
2 -Either Party may terminate this Agreement at any time by giving notice to the other. In that event the Agreement shall cease to have effect three months after the date of receipt of the notice.
In witness whereof the undersigned, being duly authorised by their respective governments, have signed this Agreement.
Done at the Hong Kong Special Administrative Region, this twenty-fourth day of May in the year of two thousand and one in duplicate in the Portuguese, Chinese and English languages, each text being equally authentic.

Final provisions
1 -This Agreement shall enter into force thirty days after the date on which the Parties have notified each other in writing that their respective requirements for the entry into force of this Agreement have been completed with.
2 -Either Party may terminate this Agreement at any time by giving notice to the other. In that event the Agreement shall cease to have effect three months after the date of receipt of the notice.
In witness whereof the undersigned, being duly authorised by their respective governments, have signed this Agreement.
Done at the Hong Kong Special Administrative Region, this twenty-fourth day of May in the year of two thousand and one in duplicate in the Portuguese, Chinese and English languages, each text being equally authentic.
